Georgia is home to more than 100 Korean manufacturing facilities employing thousands of workers across the state. These Korean-affiliated companies include major operations such as SK Battery America, Sangsin Technology America, Qcells (Hanwha Qcells), LG Energy Solution, and many others.

Many Korean employees working at these facilities suffer from violations of American employment laws — including unpaid overtime, wage theft, national origin discrimination, sexual harassment, and labor trafficking. U.S. laws provide far greater protections to employees than Korean law. International manufacturers operating in Georgia must comply with United States employment laws. When they don’t, employees are entitled to substantial damages.

Hall & Lampros lawyers have handled employment claims against Korean manufacturers and work closely with affiliated Korean lawyers to represent you. We offer free consultations and have Korean speaking attorneys available. Call 404-876-8100 today.

Overtime Violations

U.S. laws require manufacturers to pay most workers 1½ times their regular rate for all hours worked over 40 per week. If you are working more than 40 hours per week and not receiving proper overtime pay, you may be owed significant back wages and damages.

Discrimination in Employment

U.S. laws prohibit all discrimination based on race or national origin. Some Korean manufacturers require Korean workers to work more hours than American counterparts, or pay Korean workers less in wages or overtime. This is illegal under federal law.

Sexual Harassment

U.S. laws prohibit all sexual harassment, including unwanted sexual touching, sexual pressure, or advances by supervisors or co-workers. If you are experiencing or witnessing sexual harassment at work, you have a right to take legal action.

Country of Origin Discrimination

Sometimes a manufacturer based in another country will expect its expatriate workers to work harder than their American counterparts — working longer hours, for less pay, or with less overtime compensation. This is illegal under U.S. law.

The Law Is Clear

No employer — regardless of its country of origin — can impose different work expectations or pay on workers of one nationality that it does not impose on others.

A Korean manufacturer cannot discriminate against Korean employees. A Chinese manufacturer cannot discriminate against Chinese employees. A Mexican manufacturer cannot discriminate against Mexican employees. Equal treatment is required for all employees, regardless of national origin.

Common examples of national origin discrimination include:

  • Requiring Korean employees to work longer hours than American employees
  • Paying Korean workers lower wages than American workers in the same position
  • Denying overtime pay to Korean employees while paying it to others
  • Treating expatriate workers differently in scheduling, assignments, or benefits
  • Creating a hostile work environment based on national origin

Threats of Deportation & Labor Trafficking

It is illegal for any employer to use the threat of deportation to secure labor or to force employees to work extra hours. U.S. law strictly protects workers — regardless of immigration status — from coercion, intimidation, and labor trafficking.

  • Threatening workers with deportation to compel labor is illegal
  • Confiscating passports or immigration documents is illegal
  • Using immigration status to suppress wage complaints is illegal

If your employer is threatening you with deportation or confiscating your documents, contact Hall & Lampros immediately. You are protected under U.S. law.
