FLSA questions, answered
What are typical FLSA settlement amounts?
Amounts vary widely with the number of workers, the hours worked and the pay rates involved. Of the 105 settlements listed on this page, amounts range from $1,658 to $1,400,000 and the median is $18,000. 38 are $25,000 or more and 7 are $100,000 or more. The 196 individual Darden claims range from $1,000 to $12,000, with a median of $3,100. Amounts shown are gross settlements, and most include attorney's fees and costs. Past results do not guarantee a similar outcome in any future case.
What can I recover in an FLSA unpaid wage or overtime case?
Under the Fair Labor Standards Act, a worker can recover unpaid minimum wages and unpaid overtime, plus an equal amount as liquidated damages, which usually doubles the recovery. The employer must also pay the worker's reasonable attorney's fees and costs (29 U.S.C. § 216(b)). Most of Hall & Lampros's FLSA results include liquidated damages. How long do I have to file an FLSA claim?
Generally two years from each underpaid paycheck, or three years if the violation was willful (29 U.S.C. § 255). Because the deadline runs paycheck by paycheck, waiting can shrink the recovery, so it is best to talk to a lawyer soon.
Can I file an FLSA claim if I no longer work for the employer?
Yes. Former employees can bring FLSA claims for unpaid minimum wages and overtime. The deadline (two years, or three for a willful violation) runs from each underpaid paycheck, so the sooner you act, the more of your unpaid wages you can recover.
I'm paid a salary. Can I still be owed overtime?
Yes. Being paid a salary does not by itself make a worker exempt from overtime. The job duties and the salary level both have to meet the legal test. Many of our results involved salaried workers who alleged they were misclassified as exempt, including IT technicians, kitchen workers, grocery workers and inspectors.
My employer calls me an independent contractor. Am I covered?
Possibly. The label an employer uses does not decide the question. Courts look at the economic reality of the relationship, such as how much control the company has over the work. Our results include roof-inspection technicians, installers and drivers who alleged they were treated as contractors or exempt and recovered unpaid wages.
I'm a server or bartender. What is a tip-credit violation?
Employers may pay tipped workers a cash wage as low as $2.13 an hour and count tips toward the $7.25 federal minimum wage, but only if they follow the FLSA's rules. Common violations include tip pools shared with managers or non-tipped staff, making servers spend substantial time on non-tipped side work at the tipped rate, and off-the-clock work. Can my employer fire me for complaining about my pay?
No. The FLSA makes it illegal to fire or punish a worker for complaining about unpaid wages or for taking part in a wage claim (29 U.S.C. § 215(a)(3)). Retaliation can bring its own damages.
What is an FLSA collective action?
A collective action lets workers with the same pay problem bring one case together. Each worker joins by filing a written consent. Hall & Lampros has handled collective actions for groups of merchandisers, field technicians and restaurant workers, including a $1,400,000 settlement against The Valspar Corporation and a $910,000 settlement for 78 roof-inspection technicians.
What are liquidated damages under the FLSA?

A court may reduce or deny them only if the employer proves it acted in good faith and had reasonable grounds to believe it was following the law (29 U.S.C. § 260). Do Georgia and Tennessee have their own overtime or minimum wage laws?
Neither state has a general overtime law for private-sector employees, so overtime claims for most workers in Georgia and Tennessee are brought under the federal FLSA. Tennessee has no state minimum wage law. Georgia's state minimum wage ($5.15 an hour) applies only to a narrow group of workers who are not covered by the FLSA; most workers are entitled to the federal minimum wage of $7.25 an hour.
